Rectification and Mortgage Fraud by Matthew Haynes
In this article, Matthew Haynes considers the recent Court of Appeal case of Dhillon-v-Barclays Bank plc and the Chief Land Registrar [2020] EWCA Civ 619 where Mrs Dhillon unsuccessfully sought rectification of the register arising from mortgage fraud. She sought to have a legal charge in favour of Barclays Bank (BB) removed from the register. Neither BB nor the Chief Land Register supported her application.
