Practice Details :

Experienced in the prosecution and defence of possession claims under the Housing Acts, including claims for unlawful eviction, harassment and the appropriate measure of damages;

-the prosecution and defence of disrepair claims under the Landlord and Tenant Act 1985;

-environmental claims relating to statutory nuisance and fitness for habitation;

-judicial review in respect of homelessness decisions by local authorities;

-the prosecution and defence of applications for anti-social behaviour orders, both in the County Court and the Magistrates Court;

-mortgage possession claims, particularly involving the Consumer Credit Act 1974;

-disputes between landlord and tenant over service charges and other matters under the jurisdiction of the Leasehold Valuation Tribunal;

-commercial landlord and tenant work.

Mr Stephens has also acted successfully as a mediator in respect of disrepair claims and other landlord and tenant disputes. In addition he sits as a Recorder in the County Court and the Technology and Construction Court and as a Tribunal Judge in the Social Entitlement Chamber.
