Career:
After pupillage joined Chambers as a tenant in January 1989. Head of the Housing Group in Chambers.
Practice:
All aspects of housing law and related fields. Has considerable experience in claims arising from stock transfers.
Possession claims, particularly those involving anti-social behaviour, tolerated trespassers and human rights issues.
Disrepair, including claims under the Environmental Protection Act 1990. Has acted for local authorities co-ordinating responses to attempts to overwhelm by issuing multiple claims on the same day.
Regulatory work including Environmental Protection Act 1990, unlawful eviction, planning enforcement and health and safety proceedings.
Regularly instructed by and on behalf of local authorities, housing associations and by some specialist tenant advisers.
Notable Cases:
Frisby v Birmingham CC [2010] EWCA Civ 336, one of five appeals heard together by the Court of Appeal considering the extent and availability of public law defences and human rights challenges to possession proceedings in the county court.
Knowsley Housing Trust v White [2008] UKHL 70, Housie of Lords ruling on tolerated trespassers; also appeared in the case in Court of Appeal and Liverpool County Court.
Porter v Shepherds Bush HA [2008] EWCA Civ 196, Court of Appeal ruling on tolerated trespassers. Unable to act for Shepherds Bush in House of lords due to conflict of interest with Knowsley.
O’Neill v Sandwell MBC [2007] EWHC 3004 (QB) High Court appellate ruling on alleged bias by trial judge.
Knowsley Housing Trust v Arthur Revell : Helena Housing Ltd v Gillian Curtis [2003] EWCA Civ 496. Court of Appeal ruling on effect of stock transfer on existing possession proceedings.
Emma Jones v Walsall MBC [2002] EWHC 1232 (Admin) Administrative Court ruling on what was required for a landlord had to go make out a defense to a statutory nuisance claim.
