Practice Details :

Mark joined chambers in August 2007 having previously been a member of 1 Pump Court chambers in London.  Mark practices primarily as a human rights and civil liberties specialist.  This expertise is incorporated into his practice in the areas of crime, prison law, judicial review, police actions, inquest law, immigration, and anti-social behaviour law (including both CRASBO and ASBI housing cases).

 

Human Rights

Mark has experience in advising on cases raising issues under the Human Rights Act and international human rights instruments.  He is currently assisted by Amnesty International, advising a Lithuanian NGO on potential proceedings concerning the death penalty in Belarus.   

Aside of his daily practice Mark is frequently employed as an international human rights consultant for international organisations, providing human rights training for judges, prosecutors, defence lawyers, police, governors, the office of the Ombudsman, and human rights defenders. He is engaged on projects across Europe and Central Asia in Albania, Armenia, Azerbaijan, Georgia, Lithuania/Belarus, Macedonia, Moldova, Russian Federation, and Turkey.

Criminal Law

Mark is an experienced criminal practitioner, regularly instructed in the Crown Court in cases of serious violence, sexual offences, theft, drugs, public order offences and regulatory crime.          

Mark has particular skill and experience in dealing with vulnerable defendants, both juveniles and the mentally ill.

 

Prison Law

Mark is an experienced prison law practitioner.  He undertakes work in respect of parole, adjudications, civil claims against the detaining authorities, inquests, and judicial review and human rights claims.  He able to offer advice on issues such as categorisation, allocation, access to prisoners, drug testing, health care, disability rights and prison conditions. 

He has a detailed knowledge of human rights law jurisprudence in respect of prisoners.  He is frequently requested to act a human rights expert for the Council of Europe, advising governments and lawyers in foreign jurisdictions throughout Eastern Europe and the CIS on issues concerning prison reform and adherence to European Prison Standards. 

He is also willing to assist in the drafting of amicus curiae petitions in death penalty cases.

Immigration, Asylum and Nationality Law 

Mark advises on asylum appeals, issues concerning British Nationality law and entry clearance appeal cases under the immigration rules in respect of visitors, workers, family members etc.  He is experienced in utilising the Human Rights Act in hearings before the AIT.

Police Actions

Where issues arise in relation to the use of police powers, Mark is able to advice claimants in relation to claims of assault, battery, false imprisonment, malice prosecution, misfeasance, and discrimination claims brought under the Race Relations Act.

Inquests

Mark is a member of INQUEST Lawyers’ Group. He is available to assist bereaved family members in representing their interests in the coroners’ courts. He previously assisted counsel in the preparation of judicial review proceedings following the inquest into the death of Pte Jason Smith who died in Iraq in 2003.

Anti-Social Behaviour Law

Mark is experienced in representing defendants in the criminal courts in relation to stand-alone and post-conviction CRASBOs.  He recently successfully argued that a CRASBO was unnecessary on account of the defendants I.Q/mental health difficulties which would have rendered him unable to comply with the proposed terms.

In the County Court Mark regularly acts for both claimant and respondent in relation to ASBI proceedings brought under the Housing Act 1996.

Judicial Review

Mark is able to offer advice, representation and training on issues related to his specialist areas of practice.  

Training

Mark is available to provide training on human rights law, criminal law and prisoners’ rights.  He has also provided training on UK Anti-Terrorism Legislation for Central Law Training (CLT).  He is a Human Rights Expert for the Council of Europe, providing training on all aspects of international human rights law. 

He is a member of the Criminal Bar Association, Liberty, Human Rights Lawyers Association, Inquest Lawyers Group, Legal Action Group and the Police Actions Lawyers Group.
