Practice Details
Elizabeth Isaacs is an experienced barrister who specialises in child law. Before being called to the Bar in 1998 Elizabeth worked as a local authority child protection social worker for 8 years.
Elizabeth regularly appears in complex care and adoption proceedings involving serious physical injury, child death, emotional harm, neglect, and child sexual abuse. Elizabeth acts on behalf of local authorities, parents (or interveners), children and the Official Solicitor.
Elizabeth has a particular interest and expertise in issues relating to local authority practice and procedure, disclosure and public interest immunity. Elizabeth has considerable experience in challenging local authority decision making in relation to children and vulnerable adults, including use of Judicial Review and the Court of Protection.
Elizabeth is also regularly instructed to act in private law children matters, particularly cases involving fact finding relating to allegations of serious violence or emotional harm, implacable hostility and the direct representation of children by rule 9.5 guardians.
Notable Cases and Other Work
Elizabeth has been led in several complex cases in the Court of Appeal. In Re B (Appeal: Lack of Reasons) [2003] 2 FLR 1035 (CA) Elizabeth acted as junior counsel on behalf of the local authority in a leading case which confirms approved remedies and procedure in cases where defective judicial reasons have been given.
Elizabeth acted as junior counsel on behalf of the successful appellant mother in Re W ( Care: Threshold Criteria ) [2007] 2 FLR 98 (CA), a case dealing with the return of a child to her mother after fresh evidence rebutted earlier allegations of sexual abuse. The case also considered the need for expert evidence to be subjected to sufficient critical analysis by the court, and identified the need for caution in removal of children from parents with low IQ.
In 2007 Elizabeth conducted an independent investigation on behalf of a local authority following judicial criticism of social work practice and procedures in relation to a complex case involving neglect and parents with learning disabilities.
Other Work
Elizabeth is a pupil supervisor and a member of the Chambers’ Pupillage Committee.
Elizabeth has recently conducted training about the ACA 2002, Public Law Outline and assessments of parents with learning disabilities. Elizabeth is frequently commissioned by local authorities and legal training organisations to design and provide training about on developments in case law and legislation, advocacy, practice and procedure, is regularly invited to lecture at the Jordans Local Authority Child Care Conference and chaired the 2009 Jordans Advocacy in Childcare course.
